How to check your client data if the service provider has ceased operations and the data has been transferred to Kela

If a private provider of healthcare and social welfare service ceases operations, it must ensure that the patient and client data are stored and archived securely. Different organisations can be responsible for storing and archiving the data. These instructions are for clients who want to check the patient data that has been transferred to Kela.

If a private provider of healthcare and social welfare services ceases operations, it must submit the patient and client documents kept in its register to Kela, unless

  • they have already been submitted to a wellbeing services county
  • they have already been stored in the Kanta Services
  • a municipality, a joint municipal authority, a wellbeing services county or another company is contractually responsible for storing and archiving them. 

If a client has accessed private healthcare or social welfare services using a voucher issued by a municipality, a joint municipal authority or a wellbeing services county, for example, the party issuing the voucher is responsible for storing and archiving the data.

Kela receives data requests from clients

As from 1 January 2024, Kela will act as the contact point where clients can submit their data requests concerning the documents. Kela forwards the data requests to the wellbeing services county, who discloses the information to the clients. The wellbeing services counties are responsible for any other data controller obligations, such as handling requests for administrative review and rectifying data.

The information can be disclosed to the clients themselves, to another person with the client’s consent or to another party with a legal right to obtain the information. The people making data requests must prove their right to obtain the requested information.

How to make a data request as a client

Clients can make data requests concerning documents transferred to Kela by submitting the requests via encrypted email to the address toimintansa.lopettaneet@kela.fi. Kela forwards the requests to the wellbeing services county for disclosing the information. The wellbeing services county contacts the person requesting the information.
